The DVLA has warned drivers to make sure they are complying with all rules while waiting for their license renewal.
Drivers can stay on the road if they applied for their driving license but it expired during the application.
If a doctor has given you up to drive because of illness or if you have submitted an incorrect or incomplete application to the DVLA, you can be banned from driving.
Once the DVLA has received your correct and complete application for a new driver’s license and you meet all of the Section 88 criteria, you are allowed to drive.
You need to make sure that the state of health you indicated on your application is not preventing you from driving.
If you are not sure, ask your doctor before making a decision.
You can also look up your condition in the “Assessing Fitness to Drive” guide.
The provision of Section 88 applies to UK law only and may not be accepted in other countries.
It is best to inquire with the responsible licensing authority before starting your journey.
Section 88 of the 1988 Road Traffic Act may allow you to continue driving even if your old driver’s license has expired while waiting for a new one.
However, you must comply with all requirements, otherwise you could be excluded from road traffic.
